The legal basis for compulsory vaccination against coronavirus infection was explained in the Ministry of Justice of the Republic of Kazakhstan, Kazpravda.kz reports with reference to the Ministry of Justice.

“In order to prevent the emergence and spread of infectious and parasitic diseases, preventive vaccinations are one of the sanitary and anti-epidemic measures provided for by the Code “On people's health and health care system”.

Individuals who do not have medical contraindications, who are permanently on the territory of the Republic of Kazakhstan, are required to receive vaccinations against infectious and parasitic diseases (paragraphs 4 and 8 of Article 85 of the Code), including preventive vaccination against CVI (in accordance with the decree of the Government of the Republic of Kazakhstan dated September 24, 2020 No. 612)", - explained in the Ministry of Justice.

Thus, there are legal grounds for compulsory vaccination against coronavirus infection for persons who do not have medical contraindications, and this is consistent with the constitutional provision that “the state aims to protect the environment favorable for human life and health” (Article 31 of the Constitution). While guaranteeing the rights and freedoms of a person and a citizen, the Constitution of the Republic of Kazakhstan does not exclude the possibility of their limitation, at the same time indicating the permissible limits of such a limitation. Rights and freedoms can be limited only in order to protect human rights and freedoms and public health (paragraph 1 of Article 39 of the Constitution), the ministry concluded.
